Servant Charged With Stealing and Concealment of Evidence

At a called Court held for Augusta County the thirtieth Day of January one thousand seven Hundred and seventy five for the examination of Matin Whitsal and Catherine Bartley who stand committed to the Goal of this County charged with stealing sundry Goods and Money from Danl Kidd

The above named Martin Whitsel and Catharine Bartley were led to the Barr and upon Examination Denied the fact wherewith they stand Charged whereupon witnesses were sworn & Examined upon Consideration of which the Court are of opinion that the said Catharine is guilty of a Breach of Trust and it is ordered that the said Catharine servant to the said Danl receive on her Bare Back thirty nine Lashes well laid on and it is order'd that the Sheriff execute the same immediately and that the said Martin is Guilty of a Misdemeanor and that he be committed to the Goal of this County and there remain until he enter into recognizance in the sum of twenty Pounds in the sum of ten pounds each to be levied and in case he doth not appear at the Grand Jury Court that his Majesty Deputy Attorney Prosecute him for the same

Danl Kidd came into Court and acknowleged himself Indebted to our Lord the King in the sum of twenty pounds to be levied of his Goods and Chattels Lands & Tenements in case he doth not appear at the grand jury Court in May Court to give Evidence against Martin Whitsel touching a Misdemeanor in Concealing Goods and shall not depart thence without Leave of the Court Then the Court arose.
