No jurisdiction over POWs

The accused [Kanzo Kawachi] ... made a plea to the jurisdiction of the comission on the ground that Proclamation No. 4 of the Military Government of Guam of which the commission may take judicial notice expressly states that the military commission does not have jurisdiction over prisoners of war.
