WILL OF ROBERT HUSTEAD OF FAYETTE CO PA, dated 27 Aug 1827; proved 7 Jul 1838 (Book 2, page 124)

I, Robert Hustead, of the County of Fayette & Commonwealth of Pennsylvania, possessing perfect health and my usual soundness of mind do make, ordain, and declare the following to (be) my last will and testament. That is, to my mortal body I order and direct a decent christian burial at the discretion of my executors and my debts which will be few punctually paid. To my beloved wife Sarah I give and bequeath during her natural life the use & occupancy of my dwelling house with all & singular the furniture therein contained & attached, also one horse creature, two cows, and eight sheeps, such as she may choose together with the use & occupancy, rents, issues and profits of all that part of my land that I have lately, and now do farm. To my son John I give & bequeath three fourths of the tract of land on which he now lives containing 132 acres but the use and benefit of the whole during his natural life. To my grandson David and son of John, I give and bequeath one fourth part of tract 132 acres whereon his father lives from and after the decease of his father also to the said David I give and bequeath a part of my home plantation as by a platt No. 1 the whole being divided into five parts by corners & distances (which platts will accompany this instrument) No. 1 covering my dwelling house and the same I left to my wife during her life. To my daughter Lydia Traer I give and bequeath a part of my farm home plantation surveyed and platted No. 2 to her and her husband George Traer during their & each of their natural lives and to the issue of the said Lydia (if any) forever. But if the said Lydia dies without issue the lot numbered 2 I order and direct to devise to my grandson David and to my grandsons John, Samuel & William and granddaughters Sarah & Lydia, all children of my son Alexander. I give and bequeath the part or parcel of my home plantation surveyed and . . . (bottom of page appears to be torn or worn off.) . . . and education of the younger ones, and when William the youngest comes to the age of twenty one years the whole to be equally divided amongst the four. To my grandson Robert & son of David when he arrives to age of twenty five years I give and bequeath that part of my home plantation surveyed & platted No. 4, the rents, issues and profits thereof untill the said Robert arrives to the age of twenty five years to be equally divided between the sisters of the said Robert to wit, Lydia, Ann, Sarah, & Maria. Whereas there is on lott No. 3 one of two bequeath ed to my grand children by Alexander a good coal bank I do order & direct that a free use of the coal from said bank be allowed to each of my heirs inheriting any part of my home plantation for their house consumption with the right way, free egress and ingress to them, their heirs and assigns forever. Having already given to my grand son David one bay stud horse colt, and to my grand daughter Sarah two cows and one beaureau I do now give & bequeath to them David & Sarah after my wife shall have made choice of the creatures hereinbefore bequeathed to her the residue of my personal estate. Whereas on lott No. 1 bequeathed to my grand Son David there is a burying place or grave yard to which I do hereby attach adjoining five acres of land for the sole behalf of keeping the said grave yard in repair, that is for keeping the fences good, and the ground clear of weeds & briars which five acres I hold to the use & benefit of the sd David so long as he continues to perform the duties before assigned, but in default of David's so doing to such other of my heirs as will duly attend thereunto, the five acres of land set apart as aforesaid lying and being on lott No. 1 bequeathed to David he shall not at any time sell, give, or bequeath allien the same from the use & purpose herein expressed and intended. I do appoint my son John Hustead and my friend Andrew Oliphant to be the executors of this last will & testiment. Signed, Sealed, Published & pronounced as the last will and testament of the testater in the presence of the undersigned witness, I and they in the presence of each other, the 27th Augt 1827.

Be it known that I, Sarah Hustead, widow & relict of the late Robert Hustead the foregoing Testator do accept the bequest made to me in the foregoing will & testament by my late husband in full Dower from the estate of my late husband and entirely concur in the said will. Witness my hand & seal the 2nd day of July 1838.
