Was taken prisoner on charge at Ft Gilman, Virginia. A chess set was made from the windowsill at the Libby Prison by his friend Lt. {Joseph }Henry Ferguson. Robert named his son Carleton Ferguson Spinney after him. Robert was a POW from 29 Sep 1864 to 21 Feb 1865.
