3 Affidavits for J.W. JACKSON by James M BURNETT

State of Tennessee

Putnam County

In the matter of the Pension claim of J.W. JACKSON for State Pension, held up for additonal evidence, Personally comes James BURNETT, aged 56 years, and whose post office address is Void, Putnam County, Tenn.  And being first sworn deposes and says, That he was a private in Capt. R. Robisons Co H 28th Tenn. Inf. and that some time in the month of August 1863, he, offiant, and claimant, and Benj. BROWN both members of his Co. and all three sick, and unable for duty at the time, were Captured at Mission Ridge by the Federal Army, they three, were sent to Stevenson, Alabama, and remained there something near a week, we three were then sent up to Nashville, and all of us three being very feeble, asked the, the Federal Authoritys to not send us to the Northern prisons to die.  And while we three were in the Capital of Nashville, Tenn.  And he began to intercede with the Officers on our behalf.  And, Affiant, then remarked to the Officers, that he had three Sisters living at Carthage, Tenn. and a brother-in-law also.  and that if they, the Federal Authorities would give him a Parole that he would go there and Stay, and after consultation they told us three, that if we promise them to go there, at Carthage, and stay that owing to our condition and the circumstances surrounding it; our health etc. they would give us a parole.  We promised them, and they give each of us three a parole, and I carried mine in my pocket during the remainder of the war, and I kept it for some years after the war, and suppose I threw it away, that is my remembrance of its disposition.  Benj Brown above named has been dead for many years.  These are the facts in the case as I know them and understand them.  I have no interest whatever in this claim, only to help a poor old totally blind, Soldier

Personly came James BURNETT before me the undersined Authority and Makes oath as required by law in the cause of J.W. Jackson, an aplicant for Pencion under the Statutes of the State of Tennessee.  Granting Pencions to Disabled Soldiers in the Late War between the States affiant States that he was in the armey as a Soldier and Served with claimant J.W. JACKSON.  affiant further States that they both belonged to Co H 28th Tennessee Infantry Voleteers he further States that claimant was a true Soldier and was Prompt to his duty allways reddy to obey his commanding officers and free from disoner and free from desercion he also States that the claimant never Went home Without a Ferlow and allways returned in dew time.  affiant further States that he was a Messmate With claimant and hav a good rite to Know Whereoff he Speaks & so this Jan 29th 1892.

Putnam County    {  In the matter of the claim for State Pension of J.W. JACKSON, Personally came before me the undersigned Authority, James BURNETT, a citizen of said County and State, and being first sworn deposes and says that he was a comrade of J.W. JACKSON in the same Company & Reg't.  was not present when he was wounded as I was with Colonel SAVAGES Regiment that day, but saw him frequently the next day and on.  And I heard all about his wound and about his eyes being knocked blind by the shell bursting in his face, and the wounding of his head, and his head all swelled up ant shape. and his face all bruised black.  I know that he never had to do any hard military duty aftersards, never went on the Drill field, but done little things for the boys, suc as mending shoes, bridles etc. for the Comman.  I was with claimant when he was captured between Chattanooga & Dalton, and was taken to Nashville and there paroled.

 

Sworn to and Subscribed before me this 15th day April 1892.  And I certify that I read said affidavit to affiant and acquainted him with its contents before he executed the same and that I have no interest in his claim.

He married Luvisa Jane JACKSON *Burnett ABT 1855 in White Co, TN {now in Putnam Co, TN}, daughter of James JACKSON Esq. and Saroah 'Sallie' COX *Jackson. She was born 25 MAR 1835 in White Co, TN {now in Putnam Co, TN}, and died 26 DEC 1903 in Putnam Co, TN. She was buried DEC 1903 in Sand Springs, CD No 5{now 4}, Putnam Co, TN. 

James was a Private in Company H, 28th Tennessee Infantry Volunteers in the war between the United States and the Confederate States.  He likely enlisted in 1861, when John Washington 'Fox' Jackson, another soldier in his unit did so.  James was a witness to Fox' Pension application and this is when Fox enlisted.  James was captured  during the war and eventually allowed to return home.

She was born 14 FEB 1863 in Putnam Co, TN, and died 3 MAY 1927 in Putnam Co, TN. She was buried MAY 1927 in Sand Springs Cemetery, CD No 5, Putnam Co, TN. He married Sarah Gerusia HOWARD 20 AUG 1880 in Putnam, TN, USA, daughter of Zemmery P HOWARD and Sarah Jerusia STEPHENS. She was born 29 APR 1853 in White/Putnam Co, TN, and died 18 JAN 1918 in Leonard, Fannin, Texas, USA.

She married James C "Jim" ROCKWELL 28 DEC 1881 in Putnam Co, TN; vol 1, page 401, son of Robert ROCKWELL and Sarah Margret BUCK. He was born 27 MAR 1859 in 3rd CD, Putnam Co, Tennessee, and died 06 MAR 1906 in 3rd CD, Putnam Co, Tennessee. He was buried 07 MAR 1906 in north of Hidden Hollow, CD 3, Putnam Co, TN.
